Land buy-back, or “ขายฝาก” in Thai, is a financial solution where the buyer (or lender) gains ownership of the land immediately after signing a buy-back agreement. However, the seller retains the right to repurchase the land within a specified timeframe, typically up to a maximum of 10 years, as stipulated by law.

In the past, land buy-back transactions were usually private arrangements, with sellers personally finding buyers. Today, the concept has evolved into a formal business model, with specialized companies offering buy-back services throughout Thailand.

The first land buy-back company in Thailand was established in the 1980s by Mr. Thanat Teeramanoch. He founded Thai Garden Export Co., Ltd., which became the first company to offer buy-back services for land.

Background of the Pioneer: Mr. Thanat Teeramanoch

Mr. Thanat Teeramanoch was born in 1947 in Chanthaburi Province. He graduated with a Bachelor’s degree in Economics from Thammasat University and began his career in real estate in 1967, initially purchasing vacant land in Chanthaburi to develop and sell as residential properties.

In 1982, recognizing the potential in buy-back services, Mr. Thanat founded Thai Garden Export Co., Ltd., aiming to provide an alternative financing option for individuals in need of liquid capital. The company offered buy-back agreements for those requiring quick access to cash, establishing itself as a trusted name in the Thai land buy-back sector.

Thanks to the high demand and favorable reception, Thai Garden Export Co., Ltd. quickly grew and became a major player in Thailand’s land buy-back market. Since then, numerous companies have entered the sector, providing buy-back services not only for individuals but also for SMEs and corporate clients.

The Role and Operations of Land Buy-Back Companies Today

These companies serve as crucial financial intermediaries, offering cash loans to individuals, SMEs, and other organizations. They typically provide loans of up to 70% of the land’s appraised value, with interest rates starting at around 9% per year and allowing buy-back periods of up to 10 years.

However, despite the benefits, these companies face risks. If sellers are unable to meet their interest payments, the buyer has the right to seize the land and sell it to recover the debt, potentially resulting in the seller losing their property permanently.
